PERFORM SERVICES AS AN INDEPENDENT FOR IN THE SETTLEMENT AGREEMENT IN

V. CITY OF OAKLAND, ET AL., U.S.D.C. CASE

PURPOSE AND SCOPE

In accordance with the Measure H Charter Amendment, which was passed by the voters at the General election of November 5, 1996, we have made an impartial financial analysis of the accompanying Council Agenda Report and Proposed Resolution.

Since our independent financial analysis was not an audit, we did not apply Government Auditing Standards as issued by the Comptroller General of the United States.

SUMMARY

At its April 8, 2003 meeting, the City Council

Agreement Steering Committee's recommendation of Relman &

choice for Independent Monitor. In response to the Council's request, the Office of the

approved the Riders' Settlement Associates as the City's

City Attorney has prepared a draft Professional Services Agreement for the Public

Services Conm review.

FISCAL IMPACT

The Settlement Agreement specified that the maximum cost of implementing the agreement over a 5-year period would be $4 million. The draft contract with Relman & Associates specifies an amount not to exceed $3,576,898.82 over the 5-year period, and is within the specified maximum cost.

SELECTION PROCESS

The Riders' Settlement Agreement Steering Committee, consisting of the City Manager, Chief of Police, and staff from the Office of the City Attorney, evaluated the candidates for Independent Monitor, and recommended that Relman & Associates' be selected. As part of the selection process, OPD staff (1) contacted nine police agencies operating under consent decrees that are similar to Oakland's Settlement Agreement; and (2) also completed background checks of Relman & Associates' team members, in view of the sensitivity and confidentiality of the information to be reviewed.

CONCLUSION

The proposed resolution appears to be reasonable.
