One-Time Revenues To Balance The Midcycle Budget

Recommendation: Adopt A Resolution: (1) Authorizing The Use Of One-Time Revenues  
To Balance The Fiscal Year 2026-27 Midcycle Budget Pursuant To Section 1, Part D Of  
The City Of Oakland Consolidated Fiscal Policy  
(2) Declaring A State Of Extreme Fiscal Necessity And The Existence Of A Severe And  
Unanticipated Financial Event That Has Adversely Impacted The General Purpose Fund  
Such That The City Is Unable To Budget At The Required Minimum Number Of 700  
Sworn Police Personnel Pursuant To “The Oakland Community Violence And Emergency  
Response Act Of 2024” (Measure NN)  
(3) Declaring A State Of Extreme Fiscal Necessity, To Provide For The Temporary  
Suspension Of The ‘Park Maintenance’ Maintenance Of Effort Requirements, Pursuant  
To The 2020 Oakland Parks And Recreation Preservation, Litter Reduction, And  
Homelessness Support Act (Measure Q)  
(4) Declaring A State Of Extreme Fiscal Necessity For The Midcycle Budget, Allowing  
For The Minimum Budget Set-Aside For Public Campaign Financing To Be Suspended,  
Pursuant To The Oakland Fair Elections Act  
(5) Declaring A State Of Extreme Fiscal Necessity For The Midcycle Budget, And  
Temporarily Suspending 1) The Requirement To Consider Advisory Board  
Recommendations Prior To Appropriating Sugar-Sweetened Beverage Tax Revenue  
(6) Declaring A State Of Extreme Fiscal Necessity For The Midcycle Budget, Authorizing  
The Use Of Funds Deposited Into The Affordable Housing Trust Fund (Fund 1870) To  
Balance The Fiscal Years 2026-27 Midcycle Budget  
(7) Establishing The Intention Of The City Council To Prioritize Restoration Of Services

Subject: FY 2026-27 Proposed Midcycle Budget

Recommendation: Adopt A Resolution (1) Adopting The Midcycle Budget For Fiscal  
Years 2026-27 And Appropriating Funds And Revenues To Cover Expenditures  
Approved By Said Budget; And  
(2) Authorizing The City Administrator To Transfer Funds Between Departments,  
Programs And Funds As Necessary To Support Operations As Set Forth In The Adopted  
Policy Budget For Fiscal Year 2026-27; And  
(3) Authorizing All Actions Necessary To Apply For Accept And Appropriate Additional  
Funds Required To Advance And Complete The Projects Identified In The Capital  
Improvement Program Provided That Such Acceptance Is Consistent With And Does Not  
Otherwise Negatively Impact The City’s Capital Improvement Program; And  
(4) Authorizing The City Administrator To Accept And Appropriate Future Settlement  
Proceeds Received By The City; And  
(5) Authorizing The City Administrator To Accept And Appropriate Future Insurance  
Recoveries Proceeds Received By The City For The Repair Or Replacement Of  
Damaged City Assets; And  
(6) Authorizing The City Administrator To Appropriate Funds As Necessary To Satisfy  
Legally Required Payments Or Payments Related To Unfunded Liability; And  
(7) Declaring A State Of Extreme Fiscal Necessity And The Existence Of A Severe And  
Unanticipated Financial Event; And  
(8) Suspending For Fiscal Years 2026-2027 The Charter Mandated Minimum Staffing  
Budget Set Asides For The Public Ethic Commission; And  
(9) Suspending The Minimum Budget Set Asides For The Democracy Dollars Fund And  
For Non-Staff Costs Related To The Public Ethics Commission’s Administration Of The  
Oakland Fair Elections Act’s Democracy Dollars Program

There was a Motion By CM Ramachandran and Seconded By Council President  
Jenkins To Approve Staff's Recommendations As Amended To Include The  
Following:  
Policy Directives:  
1) Direct the City Administrator to present quarterly updates on the impact of the  
2025 Encampment Abatement Policy to the Life Enrichment Committee. This  
informational report should include, but not be limited to, the number of  
encampments addressed pursuant to the policy, locations of said encampments,  
the departments involved, shelter offers and placements, resources expended for  
operations (cleanings, relocations, closures), demographic data, number of  
relocations to low-sensitivity areas (encampments and RVs), any updates to the  
sensitivity maps, etc.  
2) Direct The City Administrator To Present Quarterly Updates To The Public Safety  
Committee On The Status Of Civilianization And Moving The Internal Affairs  
Division To CPRA Per City Council Direction Provided In Previous Budget Cycles.  
The City Of Oakland Has Completed Studies And Information Reports Dating Back  
To 2008, Identifying Sworn Administrative Positions In The Police Department That  
Could Be Performed More Affordably By Civilian Staff. The Council Should Be  
Informed Of The Progress In Implementing Past Directives For Transparency And  
Accountability Purposes.  
And As Amended By Administration: The report on updates to the Public Safety  
Committee on the status of Civilianization at the very least, twice a year  
3) Direct The City Administrator To Explore A Cultural Facilities Bond Measure To  
Address Deferred Maintenance And Capital Improvement Needs In Key Community  
Resources, Including The Malonga Casquelourd Center For The Arts And  
Children’s Fairyland. The City Administrator Shall Provide A Report And  
Recommendations To The City Council No Later Than May 2027.  
And As Amended By Administration; The Report On The Cultural Facilities Bond  
Measure Is To Come Back In October 2027, Rather Than May 2027  
4) Direct The City Administrator To Assess The Feasibility Of Establishing A Park  
Ranger Program And Permitted Vending Locations To Address Issues Of Safety  
And Un-Permitted Activity At Lake Merritt. The Assessment Shall Include Funding  
Sources That Can Be Utilized To Support These Efforts And Shall Be Presented In  
Time To Inform Decisions In The Next Biennial Budget.  
5) Direct The City Administrator To Develop A Standard Communications Protocol  
For Departments To Update Council Offices On Major Projects, Initiatives, And  
Events That Impact The Areas They Serve. Some Departments Are Proactive With  
Sharing Relevant Updates With Council Offices, While Others Are Not As  
Consistent. A Standard Protocol Will Help Ensure Equitable Access For All Council  
Offices. Additionally, Better Communication Will Help Councilmembers In  
Assisting Departments With Any Community Outreach Needs.  
6) Prioritize Expanding senior centers hours based on exploring available funding  
and staff levels.  
Amendments To The Budget Spreadsheet:  
Fund 1010  
-Adding a One-Year Exempt Limited Duration Employee (ELDE) to Assist with  
Human Trafficking and Other Penalties Enforcement.  
-Adding Increased Funding For The Film Incentive Funding Program, Which  
Would Go Towards Administering a Contract To An Outside Agency.  
-Reallocating $250,000 From The Sugar Sweet And Beverage Tax Fund, A $50,000  
Grant To OUSD For Safe Water Access, And $200,000 For Senior Wellness  
Programs And Other Senior Centers Related Funding.  
Fund 2244  
Adding to the Community Garden Food Pilot Program a ELDE.  
A motion was made by Janani Ramachandran, seconded by Kevin Jenkins, that  
this matter be Adopted as Amended. The motion carried by the following vote:
