DEFINITION OF TERMS:  
• Action Item: shall mean any resolution, ordinance, public hearing, motion or recommendation  
requiring official vote and approval of the City Council to be effective.  
• Informational Item: shall mean an agenda item consisting only of an informational report that  
does not require or permit Council action.  
• Consent Item shall mean, for the purposes of the City Council agenda: 1) approval of Council  
minutes, and 2) any action or informational item placed on a Council agenda for a Regular  
Meeting or Special Meeting (i) as a Consent Item by the Rules and Legislation Committee, (ii)  
pursuant to Rule 28, or (iii) that a Standing Committee has forwarded to the full Council with  
unanimous recommendation for approval by the members who are present: Consent Item shall  
not include: 1) any item having a high level of public interest or controversy as determined by  
the Standing Committee Chair, or the Rules and Legislation Committee, or pursuant to Rule  
28; 2) any item that requires a public hearing or that otherwise is ineligible by law as a Consent  
Item.  
• Non-Consent Item shall mean, for the purposes of a City Council agenda for a Regular  
Meeting or Special Meeting, any action or informational item that: 1) a Standing Committee has

Recommendation: Adopt A Resolution (1) Adopting The Midcycle Budget For Fiscal  
Years 2026-27 And Appropriating Funds And Revenues To Cover Expenditures  
Approved By Said Budget; And  
(2) Authorizing The City Administrator To Transfer Funds Between Departments,  
Programs And Funds As Necessary To Support Operations As Set Forth In The Adopted  
Policy Budget For Fiscal Year 2026-27; And  
(3) Authorizing All Actions Necessary To Apply For Accept And Appropriate Additional  
Funds Required To Advance And Complete The Projects Identified In The Capital  
Improvement Program Provided That Such Acceptance Is Consistent With And Does Not  
Otherwise Negatively Impact The City’s Capital Improvement Program; And  
(4) Authorizing The City Administrator To Accept And Appropriate Future Settlement  
Proceeds Received By The City; And  
(5) Authorizing The City Administrator To Accept And Appropriate Future Insurance  
Recoveries Proceeds Received By The City For The Repair Or Replacement Of  
Damaged City Assets; And  
(6) Authorizing The City Administrator To Appropriate Funds As Necessary To Satisfy  
Legally Required Payments Or Payments Related To Unfunded Liability; And  
(7) Declaring A State Of Extreme Fiscal Necessity And The Existence Of A Severe And

Police Personnel Pursuant To “The Oakland Community Violence And Emergency  
Response Act Of 2024” (Measure NN)  
(3) Declaring A State Of Extreme Fiscal Necessity, To Provide For The Temporary  
Suspension Of The ‘Park Maintenance’ Maintenance Of Effort Requirements, Pursuant To  
The 2020 Oakland Parks And Recreation Preservation, Litter Reduction, And  
Homelessness Support Act (Measure Q)  
(4) Declaring A State Of Extreme Fiscal Necessity For The Midcycle Budget, Allowing For  
The Minimum Budget Set-Aside For Public Campaign Financing To Be Suspended,  
Pursuant To The Oakland Fair Elections Act
